Is Georgia a No-Fault State?

When purchasing insurance, it is important to understand the legal requirements in your state, and part of this will require you to know whether or not you live in what is considered a no-fault state.

What Does No-Fault Mean?

No-fault does not refer to the accident itself but to a type of coverage that kicks in when you have an accident, and it also refers to a person’s limited ability to sue the other driver for damages related to medical bills. In no-fault states, drivers are required to carry what is known as personal injury protection or PIP insurance. This policy will cover certain expenses resulting from your injuries, no matter who caused the collision. 

Georgia is a Tort State

Georgia is not listed as one of the no-fault states in our country, and because of this, it is referred to as a tort state. This means that a driver automatically has the right to be able to bring litigation to recover expenses without waiting for their PIP limits to be reached. Also, insurance companies in tort states do not even list PIP as an option for drivers but instead offer medical payment insurance. This is similar to PIP, but it does not place restrictions on a driver’s ability to bring another driver to court.
